TERMS AND CONDITIONS OF BUSINESS

This website is operated by Shalla Trading. Terms such as “we”, “us” and “our” refer to Shalla Trading where there are used in these terms and conditions. By purchasing something from our ecommerce store, you agree to be bound by the terms and conditions contained in this document.

1. PRICING

All prices are applicable on date of acceptance of your order and as set out in your invoice.

Prices are exclusive of VAT and VAT will be charged on the supply of Goods at the rate prevailing at the tax point date.

All prices are subject to changes without any prior notification. Please note prices at the time of placing any orders will be fulfiled.

 

 

2. ORDER CANCELLATION 

If you wish to decide to cancel your order that you have placed then it is absolutely imperative that you contact us immediately to ascertain whether the items have been dispatched or not.  If your order has been dispatched, you will then need to return the order to us and you will be responsible for paying the cost of retuning the items.   

2.1) If items have not been dispatched prior to a cancellation request our refund policy will apply.

2.2) Delivery – Once you have completed your purchase on our website (https://shallatrading.co.uk) we will begin processing your order.  We estimate that it will take up to 3 working days to deliver your order.  This is only an estimate, occasionally some items may incur delays due to unforeseeable circumstances beyond our control e.g.(courier or transport delays, or busy peak times).

2.3) Acceptance – If an order has been returned to us due to a customer not being present to receive goods on an agreed delivery date then the customer will be subject to a full re-delivery charge.

2.4) Products that are returned due to customer not being available to receive goods on an agreed delivery date will be subject to a full re-delivery charge. 

3.TERMS OF SALE

No Goods are offered on a sale or return basis. We are not authorised to accept orders on a sale or return basis. It is therefore your responsibility to sell the Goods prior to the expiry of any “best before” date.

 We reserve the right to amend the specification of any Goods if required by any applicable statutory or regulatory requirements.

 4. BEST BEFORE DATES

The best before dates on products can vary depending on the type of product or ingredients used within the products. We will dispatch products with a minimum best before date of at least 8 weeks. Most products will far exceed this.  There are however, a small number of products listed in our Yaadgaar bakeries that have a best before lifespan of approximately 3 to 4 weeks.  This is because they are fresh date products that contain no preservatives.  If you have any queries regarding best before dates before, please contact us to discuss on 0121 572 6115 prior to placing your order.

5. STOCK AVAILABILITY

We always try to ensure that we have sufficient supplies of all our stock items. However, of the rare occasion, there may be instances where certain items may be out of stock. If this occurs we will notify you via email or phone as soon as possible of any delay in fulfilment of your order.  In these circumstances, you are entitled to cancel your order if you wish to so.

6.GENERAL

We reserve the right to update and amend any of these terms and conditions at any time without notice.

Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the invalidated term was not present.

Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure.

 7. PRODUCT PACKAGING

Whilst we strive to select the product ordered as accurately as possible, packaging, ingredients, product name and / or brand may be subject to change without any prior notice. Ingredients for products are for guidelines only and may change without prior notice. If you have any ingredients enquiries or allergens then we suggest you contact the manufacturers of the product directly.

8. ONLINE SHOPPING

8.1) As an online wholesaler we will take all reasonable care to ensure that all details and descriptions displayed for the products we sell, are correct at the time when the information was entered onto our system.

8.2) We will try our utmost care to ensure that all products displayed on our website are accurate as possible in appearances, colours, textures or finishes.  Depending on what you see on your computer monitors or equipment may differ and so we cannot guarantee that images are an accurate representation of the actual goods that you are purchasing.

8.3) Your order may not to be accepted due to one or more of the below reasons, or for a reason that has not been listed below;

i) You have failed background and validation checks

ii) A error has occurred in pricing or product description

iii) A item that you have ordered is currently out of stock

iv) We are unable to verify and authorise your payment or we have reasons to believe that your payment may be fraudulent

v) There is a system or procurement failure

If any of the above events work to occur we will contact you directly as soon possible.

Once you have placed you your order on our line system you will receive a email confirmation detailing your order.  This email is notifying you that have received your order but does not confirm acceptance.

9. ORDER NOTIFICATION

When you place an order you will receive an email confirming the details of your order. Please note, this email is not confirmation that your order has been accepted by us.

10. ORDER ACCEPTANCE

Your order will only be accepted by us once your goods have been dispatched. You will receive an email to confirm this.  

11. LIABILITY AND INDEMNITY

11.1)  Shalla Trading shall not be liable for indirect, direct or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website.

11.2) You agree to assure us and our officers, agents, directors and employees immediately and on demand, against liability, claims, costs and expenses and damages, including legal fees, arising out of any breach of any of our terms and conditions.

12. JURISDICTION

These terms and conditions shall be governed in accordance with the laws of England and are subject to the exclusive jurisdiction of the courts of England & Wales.

ENTIRE AGREEMENT

These terms and conditions constitute the entire agreement between the involved parties and supersede any and all preceding and contemporaneous agreements between you and Shalla Trading whether written or oral.
